New 2025 Pardon Waiting Periods Explained
One of the most confusing parts of getting a Record Suspension (Pardon) is knowing when you are allowed to apply.
The rules have changed multiple times in the last decade, leading to a lot of bad information online. Here is the definitive rulebook for 2025.
Summary vs. Indictable
Your waiting period depends on how serious your offence was.
- Summary Offences: These are less serious crimes (e.g., minor theft, causing disturbance).
- Indictable Offences: These are serious crimes (e.g., Breaking and Entering, major fraud).
The Waiting Times
- Summary Offence: You must wait 5 YEARS after completing your sentence.
- Indictable Offence: You must wait 10 YEARS after completing your sentence.
When Does the Clock Start?
This is where most people get rejected. The 5 or 10-year clock does NOT start on the day of your court date.
It starts only after you have completed ALL parts of your sentence, including:
- Serving all jail time.
- Paying all fines (in full).
- Finishing all probation.
If you forgot to pay a $100 fine 4 years ago, your clock hasn't started yet!
